Misuse of Anti-dowry law!

Under the guise of living in a male dominated society The legislature feels the need to build up consensus on woman related laws which protect the so called weaker sex.Section 498-A in particular is a very contentious legal provision, it is a tool and weapon in the hands of opportunistic and sadistic women to falsely implicate innocent men and they are successful in doing so on account of the draconian nature of the law. Its a non-bailable and noncompoundable offence also cognisable.The President of India Smt Prathiba Patil has gone on record to say this said legal provision is rampantly misused.



The Police also exercises great caution in registering offence pertaining to Section 498 A owing to awareness created by Right Thinking men in civil Society.There are instances of men having committed suicide who have been victimised by this harsh and unjust law but media is not sensitised about it due to the stereotype that only men can be demoniac and aggressive and women are 'paragons of virtue' which is absolutely false and a gross misconception.Cruelty is open to interpretation and is still being interpreted in a manner where in women are favoured. Women can make all sorts of allegations and The police take it at face value at times without ascertaining its veracity.This kind of misuse of the law is nothing but Legal Terrorism and Its high time Our Policy Makers invite a healthy and meaningful debate on this contentious issue affecting civil society.This Legal Provision ought to compounded as its widely misused by women with ulterior motive and vested interest.


The Purpose of every Legislation is for Public interest, equity, fairness and to achieve an egalitarian society. Every Law that comes into existence must be made for the purpose of distributive and corrective justice and not of such nature that one section of society can use it as a weapon to settle personal scores with another section of society like 498 A which is being misused to an unreasonable extent, its high our law makers intervene and do some course correction or else marrying a woman from Indian Origin would become a Taboo.

Is Anna Hazare going overboard or he is within the purview of law!

Corruption in India has become extremely rampant and has reached orgasmic levels.The number of scams which have been unearthed and the amount of black money stashed in foreign banks is startling. The common man is frustrated,angry and is harbouring strong 'anti-establishment' sentiment. The judicial process,petioning to MPs and bureaucrats has not not proved to be effectvie and efficacious. There is intense corruption of extremely high magnitude in high places and It is extremely difficult to bring such people to the book owing to their connections,influence and clout. The government has not been doing enough to curb the menace of corruption besides paying lip service and empty rhetoric.The laws of the land,institutional mechanism,legal instrumentalities and judicial mechanism has not been adequate to make an example of out ones guilty of corruption and It has not detterred people from being corrupt.The level of pessimism is such that Common man ends up thinking Corruption shall remain within the system irrespective of what laws come into existence and what measures government takes and The common man has begun to take corruption in his stride as an incurable 'cancer' and rot of the system.


The Mass movement initiated by Anna Hazare for the implementation of a strong Jan Lok Pal Bill has evoked mixed reponses.Anna Hazare has garnered support from people from all sections and stratas of society from all castes,creed,religions and age groups.People have dared to take to streets and have also courted arrest.Anna's modus operandi has been viewed with scepticism and his methods have been questioned in context of its legalities,modalities and whether he is acting within the parameters of constitutional canons. The government of the day has betrayed the common man, The goverment has always shown scant regard in implementing the Directive Principles of State Policies which are fundamental for governance and not mere 'pious homilies',The government has done very little to control inflation and dealing with security. The government has lost is credibility and People are disillusioned with the present Political dispensation.The situation is getting from bad to worse,Desperate times call for desperate measures.


The government is leaving no stone unturned to deter Anna Hazare and supress him by questioning his style of functioning. Anna Hazare nevertheless is determined,steadfast and is showing exemplary conviction in his mission.The very fact he is getting support across the country and adequate media attention and coverage indicates scores of people believe and endorse the initiative he has taken. There have been allegations of black mail,unconstitutionalism and autocratic obstinacy of instigating a mob against him but the protest has so far been peaceful without any untoward incident,rioting,violence,arson and vandalism.There is no anarchy or chaos. People may support him,criticise him, government may crack a whip on him, Anna Hazare is fearless and totally committed to the cause he is espousing.

Need for India to take security very seriously!

In this day and age of technology,sophisticated armoury,nuclear arsenal and international convention on tackling terrorism,India is still lagging behind in terms of pre empting and effectively tackling terrorism,ethnic violence and esp 'home grown' terrorists like Naxaliites.Political leaders like to play to the gallery by saying there will be zero tolerance as far as terrorism is concerned but time and again this has been nothing but an empty rhetoric.The commercial capital of the country is unfortunately becoming a very soft target of the terrorists and it has become very vulnerable to terror strikes. Its ridiculous to think and say Mumbai has an indomitable spirit,its a city of resilient people and it never gets demoralised.The general public is angry,frustrated and disillusioned with the government,police and also democratic institutions like media,judiciary and bureaucracy.


No one seems safe in India as far as terror attack is concerned and India has not learnt it lessons despite attack on parliament,serial blasts in virtually all metropolis,26/11 terror attack in mumbai,terrorism in kashmir and secuirty threat posed by illegal bangladeshi immigrants. Politicians indulge in blame game after terror attacks, after terror attacks politicians across party lines must come on a common platform to show solidarity and commitment to tackle terrorism leaving aside ideology and vote banks and giving solace to victims of terror.War against terror will be successful when politicians rise above party considerations and consider terrorism as a global menace which can be dealt with only when all our policy makers think in terms of security as a serious issue rather than a political agenda meant to garner votes.


Anti terror laws may be draconian but are a necessary evil and there needs to be checks and balances within it,Human Rights concerns must also be addressed within the provisions of this law,equipping the police is the need of the hour, the local police needs special training in dealing with terror strikes which entails great degree of alacrity and anticipation. If security remains a mere concern only in words not in action then there will be sorry state of affairs and further deterioration in law and order and terror strikes will persist and continue till security becomes as significant as a budget,Lok Pal Bill and any other legislation that is hotly debated in Parliament,its time politicians address security in national interest rather than a political tool for scoring brownie points over ones political adversaries and opponents for vested interest.

floundering government in pakistan and political unrest!

The civil society in pakistan and also the government is in a helpless situation.The radicalisation of the country,sectarian conflict,nefarious activities of ISI,excesses and brutality of the Army has resulted in chaos,turmoil,turbulence and anarchy.The assasination of Benazir Butto,the misuse and abuse of anti-blasphemy law,the capture and killing of osama bin laden,attack on naval base and fidayeen attacks at several places has put pakistan in a state of utter disarray and disaster.Pakistan's covert alliance with china and aid from The U.S has not helped them curb the 'home grown' problems and also its double standards are exposed as far as providing sanctuary to terrorists is concerned. Terrorism was pakistan's own creation to procure kashmir and to spread hate ideology towards India,Its army was insufficient to tackle Indian army's might which is evident from the two wars which pakistan lost in 1965 and 1971 and also the low intensity conflict of 1999 in kargil.


People to People contact,cricket diplomacy has proved to be miserably inadequate to bring lasting and enduring peace between the two countries. 26/11 terror attacks and david headley's confession in the trial spilled the beans and the skeletons tumbled out of pakistan's cupboard as to the extent it can go to terrorise India and settle scores and score brownie points by clandestine and surreptitious methods with aid,assistance and patronage of ISI.ISI is orchestrating a fake currency racket and creating sleeper cells in India to further their agenda to destabilise Indian economy.Foreign Secretary level talks have become an exercise in futility and any sort of dialogue or initiative for peace is of no avail considering the political scenario in pakistan.



What goes around comes around,Pakistan used terrorism against India for self-serving purposes and now the same terrorist outfits are targetting the civilians and vital installations in pakistan,pakistan is tasting its own medicine.There seems to be no hope for pakistan to wriggle itself out of this predicament,its a catch 22 situation for pakistan and only divine intervention can do some course correction,The pakistan media and judiciary must resist from getting influenced by the puritanical and dogmatic ideology which is spreading like cancer and deteriorating its entire political apparatus.

Celebrities and Law!

Be you so High ,Law is always above you!Celebrities are ones who are the biggest news makers,right from their shenanigans, and their private life is a subjectmatter of keen interest to media agencies and print media in particular.Certain celebrities like Master Blaster Sachin Tendulkar and Bollywood Legend Amitabh Bachchan are larger than life icons and role models for scores of people.These celebrities are like demi gods and people look upto them with reverence and hold them in very high esteem. The media projects them in such light that the public tends to overlook their wrong doings or any breach of law by them on account of their popularity and the precedent they have set in their chosen vocation. The Law doesn't confer any immunity on filmstars and cricketers.It does provide immunity to public servants like police men,bureaucrats and judicial officers.




Shiney Ahuja got convicted for raping his maid, Sanjay Dutt has been awarded 6 years Imprisonment in the TADA case involving possession of illegal weapon and subsequently destroying it, Arundathi Roy a renowned writer sticks her neck out and sympathises with naxaliites,Preeti Jain made serious allegations against Madhur Bhandarkar of rape and Fardeen Khan was caught red handed buying narcotics. Its true celebrities have very little privacy and they are always under media 'radar'. When an actor and actress in the same film are spotted together at a 'page 3 party',the media depicts them in such manner as if there is something brewing between them, when actually the fact is that there is a professional relationship between them and they are together to promote their film. Celebrities can be unfairly targetted by their detractors and adversaries and this can put the celebrities in a state of discomfiture and embarassment and it can prejudice the human mind to believe that since they are celebrities they might have misused their charisma and popularity for some vested interest.however on the other hand its erroneous and absurd to presume that celebrities are infallible and can't err and transgress laws.There is always a hue and cry that a celebrity is targeted and is in the news for wrong reasons as he is falsely implicated owing to his/her popularity. God men today have been caught and arrested for sex racket and their followers clamour that these god men are 'divine' persons hence it is unjust to arrest them or interrogate them which is again illogical and irrational.





The law doesn't prevent anyone from achieving success in ones chosen vocation provided one attains success within the purview of law. It is incumbent on all celebrities to pay taxes and disclose their assets as they are not exempted from tax. Media must exercise restrain and use its discretion meticulously before writing anything about celebrities unless facts are verified,allegations are substantiated and accusations are corroborated with evidence as if media commits a libel against a celebrity and people realise it,people will get completely sceptical of media and generalise that celebrities can't commit blunder and its the media and legal system that is tarnishing the image of the celebrity with an axe to grind.

Judicial Pronouncements:- Ayodhya,Kasab and Godhra.

As the good old saying goes 'Justice delayed is Justice denied', 'Justice hurried is Justice buried'.As far as high profile cases are concerned the judiciary has to be extremely wary and circumspect while administering justice and giving a judgement as there is strong public opinion,political under currents and media 'trial'. It would be naive to assume judges are uninfluened by media,public opinion and political consequences of the verdict they intend to deliver. Considering all these issues in its entirety justice is based on merits,evidence,equity,good conscience and in keeping with the law of the land. The judicial system must not either become a sympathiser of the political establishment nor get swayed by public opinion nor give credence to media sensationalism.


Ayodhya verdict is perhaps the most anticipated and talked about verdict in the history of post independent India. The entire nation was on tenterhooks and security was beefed up to avert any untoward incident and nip communal flare-ups in the bud. No sooner the verdict was pronounced it was perceived as a Pro-Hindu, Pro-Bjp verdict but nevertheless the judges relied upon the merits of the matter, findings of Archeaological Survey of India,expert evidence and the nuances of title and interest of the parties to the proceedings. It was unbecoming of certain section of public and media without knowing the actual niceties of the judgements were criticial and sceptical of the judgement raising an eye of suspicion, these were people who said they would accept the verdict but since they found the verdict unpalatable made a hue and cry this change of stance smacks of hypocrisy and doube standards.

Kasab's judgement was a forgone conclusion and the fact that there was lot of money spent on his security and there was a special court constituted was the bone of contention of general public.The enormous money spend was indeed a loss to the exchequer but capturing kasab alive proved very beneficial to India as interrogating him and getting evidence India could successfully point a needle of suspicion towards pakistan and unearth the conspiracy hatched on their soil. We also proved to the entire world that the Legal system that India follows gives free and fair tial to any accused irrespective of the crime he is alleged of and this legal provisions applies to foreign nationals as well as crime is territorial in nature.

The year 2002 is the darkest year in the history of Gujrat as the gruesome killing of Car Sevaks trigerred communal riots of the most diabolic and brutal nature. Narendra Modi was demonised and alleged for being an abettor and instigator of the riots.There were all sorts of cock and bull stories that the train compartment caught fire on account of accident and this claim was debunked and denounced by patna high court when the court rejected the findings of the Banerjee Commission report. The court has held 11 guilty, despite this verdict people are still harping on post-godhra pogrom however the perpetrators of godhra train massacare are ones who polarised the people of gujrat by setting ablaze the train which had kar sevaks and now the court has said it was a conspiracy all the cock and bull stories have been put to rest.

Its high time Human Rights activists respect judicial verdicts unconditionally rather than in a manner in which if a judgement is contrary to their views there is pandemonium. Godhra verdict should be an eye-opener to the human rights activists that they need to check their facts before alleging godhra to be an accident.its time human rights activist do some soul searching and epouse issues which are imperative like catering to the family of the victims of godhra train mayhem than support the convicts in terms of their right to appeal which they are entitled to but no amnesty should be shown to such people as they are incorrigible.

Naxalism and ultra leftism is it justified does one need to sympathise with this school of thought!

Indian Political Apparatus despite its flaws and short comings is maturing as a democracy and evolving as a Republic. Leftism is a doctrine which is plausibly an ideology which can establish an egalitarian society but however this school of thought has not stood the test of time and several events in world history bear testimony to the fact that this school of thought is not a 'Divine Revelation' and panacea for human kind. Democracy gives every section of its polity an opportunity to choose the government, No one denies the fact that Some sections of society are not beneficiaries and recipients of the largesse and agenda of governance. There are Legitimate 'forums' and Institutions where one can air ones grievances and exercise ones choice in every election by exercising one's franchise.

Naxalism and Maoism is not merely a rebellious and 'antiestablishment' movement but it has undercurrents of collateral damage and its a form of terrorism which poses a grave threat to Indian democracy. Every Individual in India has some or the other grievance with the Powers-that-be but taking recourse to violence and indulging in subersive,seditious and 'war monging' pursuits isn't going to provide the intended remedy. Its startling to learn when Activists of Civil Liberties and Human Rights take pride in the fact Maoists were the ones who Championed the cause of the disadvantaged and marginalised sections of society with far greater fervor than any other crusaders. There is no doubt there is disillusionment and grouse against the Political establishment but violence,sabotage will not rectify the system and compel the parliamentarians to address the grievances of the Maoists.


The Police has not been adequately trained to combat naxal menace,The Intelligence agencies have also not been able to nip it in its bud. The bureaucracy has become the target of Maoists too.Despite the blood bath and havoc wrecked by the maoists time and again the government dishes out the rhetoric of imploring naxals to shun violence and shows its so called magnanimity to have a dialogue with them. Naxalism is spreading its tentacles far and wide, it is also likely maoists have extra territorial loyalty. Its very unfortunate the human rights lobby perceives naxalism as a harbinger of alleviating poverty, revolutionising the system and running a parallel government. India is beleaguered by ethnic conflicts,cross-border terrorism,regionalism and secessionism and naxalism is proving to be another predicament to tackle.Its high time the media and civil society exposes the double-standards of human rights activists of sympathising with naxals and the patrons of naxalism have to be dealt with an iron hand.

The modus operandi of Naxals is demoralising the Police and shaking the foundation of our political set-up, its high time the government takes stern measures to ensure it doesn't become 'Pan Indian' and become a subject-matter for film makers to glorify them and project them as messiahs of the poor and down trodden.
